2. PROCESSING OF PERSONAL DATA, LEGAL BASIS AND DELETION

According to the definition of the EU Data Protection Regulation (GDPR) and this Privacy Statement (DSE), personal data is any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Processing according to the GDPR and this DSE is any operation or set of operations which is performed upon personal data, whether or not by automated means, such as collection, recording, organization, arrangement, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Insofar as we obtain the consent of the data subject for processing operations of personal data, Art. 6 (1) sentence 1 lit. a) DSGVO serves as the legal basis. When processing personal data that is necessary for the performance of a contract to which the data subject is a party, paragraph 1 sentence 1 lit. b) DSGVO serves as the legal basis. This also applies to processing operations that are necessary for the performance of pre-contractual measures. Insofar as processing of personal data is necessary for compliance with a legal obligation to which our company is subject, Article 6 (1) sentence 1 lit. c) DSGVO serves as the legal basis.

In the event that vital interests of the data subject or another natural person make processing of personal data necessary, Art. 6 (1) sentence 1 lit. d) DSGVO serves as the legal basis. If the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller, Art. 6(1) sentence 1 lit. e) DSGVO serves as the legal basis. If the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not override the former interest, Art. 6 (1) sentence 1 lit. f) DSGVO serves as the legal basis for the processing.

The personal data of the data subjects will be deleted or blocked as soon as the purpose of the processing no longer applies. Storage may take place beyond this if this has been provided for by the European or national legislator in Union regulations, laws or other provisions to which the controller is subject. Data will also be blocked or deleted if a legally prescribed period for storage expires, unless there is a need for further storage of the data for the conclusion or performance of a contract.

 

3. NATURE AND PURPOSE OF THE PROCESSING OF PERSONAL DATA

As a matter of principle, we process personal data of our users only insofar as this is necessary for the provision of a functional website as well as our contents and services. The processing of personal data of our users is regularly carried out only with the consent of the user. An exception applies in those cases where it is not possible to obtain prior consent for factual reasons and the processing of the data is required or permitted by legal regulations, such as §§ 22 ff. Federal Data Protection Act (BDSG). Please refer to Section 8 for the rights you have as a result of the processing of your personal data, unless otherwise stated.

 

a) Access data when visiting the website

When you call up our website with the homepage https://www.drgoerg.com/, personal data is processed in order to be able to display the contents of the website on your end device (PC, laptop, tablet, smartphone or similar). This is done by the browser used on your end device automatically sending information to the server of our website. We are obligated under data protection law to also ensure the confidentiality and integrity of the personal data processed with our IT systems. For this purpose and out of this interest, the following data is logged on the basis of a balancing of interests and without your intervention:

 

  • IP address of the calling computer (for a maximum of 7 days)
  • Operating system of the calling computer
  • Browser used by the calling computer and, if applicable, the name of your access provider
  • Name and URL of the retrieved file
  • Date and time of the retrieval Referring URL and URLs that are called up by the end device via our website
  • Amount of data transferred

The legal basis for the data processing is Art. 6 para. 1 p. 1 lit. f) DSGVO. Our overriding legitimate interest follows from the above-mentioned purposes for data collection. In no case do we use the collected data for the purpose of drawing conclusions about your person. If the data is stored in log files, it will be deleted after seven days at the latest. Storage beyond this period is possible. In this case, the IP addresses of the users are deleted or alienated, so that an assignment of the calling client is no longer possible. The collection of data for the provision of the website and the storage of the data in log files is absolutely necessary for the operation of the website, so that there is no possibility of objection on your part. In addition, we use cookies and analysis services when you visit our website. You can find more detailed explanations of this under sections 5 and 6 of this data protection declaration.

b) When registering for our newsletter

On our website, you have the option of subscribing to a free newsletter. When registering for the newsletter, the data from the input mask is transmitted to us. In addition, the IP address of the calling computer, the date and time of registration are collected. For the processing of the data, your consent is obtained during the registration process and reference is made to this privacy policy. If you have expressly consented in accordance with Art. 6 (1) sentence 1 a) DSGVO, we will use your e-mail address to send you our newsletter on a regular basis. For the receipt of the newsletter, the specification of an e-mail address is sufficient. After sending your e-mail address for registration, we will send a "check mail" with a link for the entry in the subscriber list by e-mail. Only after confirming your e-mail address by clicking on the link, you will be added to our mailing list. Unsubscribing is possible at any time, for example via a link at the end of each newsletter. Unsubscribing is only revoking your consent to use your data for sending the newsletter.

 

c) When using our contact form or contact by e-mail.

For questions of any kind, we offer you the opportunity to contact us via one of the forms provided on the website. In doing so, it is necessary to provide your name, a valid e-mail address and your request so that we know from whom the request originates and can answer it. Further information can be provided voluntarily. At the time of sending the message, your IP address and the date and time of registration are also stored. For the processing of the data, your consent is obtained during the sending process and reference is made to this privacy policy. Alternatively, it is possible to contact us via the e-mail address provided in the imprint. In this case, your personal data transmitted with the e-mail will be processed. The data will be used exclusively for processing your inquiry. In this context, the data will not be passed on to third parties unless this is necessary to answer your inquiry.

Data processing for the purpose of contacting us is carried out in accordance with Art. 6 (1) sentence 1 lit. a) DSGVO on the basis of your voluntarily given consent. If the purpose of contacting you is to conclude a contract, the additional legal basis for the processing is Art. 6 (1) sentence 1 lit. b) DSGVO. The other personal data processed during the submission process serve to prevent misuse of the contact form and to ensure the security of our information technology systems and are based on the legal basis of Art. 6 (1) sentence 1 lit. f) DSGVO. The transmission of the form data via the Internet is carried out using encrypted connections.

 

d) For orders in our online shop

For the operation of our online store and the processing of your orders for goods and/or services, personal data is also collected and processed. This is done with regard to the store functions basically for the initiation or fulfillment of contracts for the purchase or for the purchase of our goods and services. In our online store, you basically have the option to order as a guest. In addition, you have the option to register a customer account or to become a member of our Coconut Club and to order via this account, which gives you the opportunity to participate in our bonus points system. In this case, please note the information under point 3. e) Registration in the Coconut Club or registration of a customer account of this privacy policy. You can find out exactly which data we collect when you place an order in our online store on the corresponding order form.

The mandatory fields are marked as such. If you provide additional data during your order process, we assume that we may also use this data to facilitate the processing of your order. A transfer of data to third parties - with the exception of the data required for the execution of the contract to contracted companies (eg transport companies) - does not take place. e) When registering in the Coconut Club or registering a customer account

You have the option to open a customer account with us by joining our Coconut Club. This gives you the opportunity to participate in our bonus points system. You can also manage your contact details, view your order history, check current order status and create notepads for our online store. In order to provide this service, the relevant personal data provided in the customer account will be collected and processed. In addition, your IP address as well as the date and time of the corresponding activity are stored at the time of your log-in as well as when your data is changed and when orders are placed in our store.

To create a user account, you must fill out an input mask with the following mandatory fields: Full name E-mail address Individual password Furthermore, we process the sales data of the last 12 months for each order in order to be able to correctly classify you in our membership program. The processing of this data is necessary to fulfill our obligations, which arise from your membership in our bonus points system for us. During the registration process for the Coconut Club we will inform you about the purpose-related storage and processing of your personal data. You can terminate your membership and close your user account at any time. To do so, please send an email to service@drgoerg.com with the info that you would like to delete your customer account. We will then delete your user account for Our Website as well as the data stored here.

Please note that even after the conclusion of a contract and even after the deletion of your Coconut Club membership, there is a need to store the personal data of the contract partner in order to fulfill contractual or legal obligations. Furthermore, any retention periods that have arisen remain unaffected.

 

4. TRANSFER OF DATA

Your personal data will not be transferred to third parties for purposes other than those listed below and within this DSE. In principle, we only pass on your personal data to third parties if:

  • you have given your express consent to do so in accordance with Art. 6 (1) sentence 1 lit.a) DSGVO,
  • the disclosure is necessary for the assertion,exercise or defense of legal claims pursuant to Art. 6(1) sentence 1 lit. f) DSGVO and there is no reason to assume that you have an overriding interest worthy of protection in the non-disclosure of your data,
  • in the event that there is a legal obligation for the disclosure pursuant to paragraph 1 sentence 1 lit. c) DSGVO, as well as this is legally permissible and necessary
  • according to Art. 6 Paragraph 1 Sentence 1 lit. b) DSGVO for the processing of contractual relationships with you.

If you use third-party payment services for the payment process (e.g. PayPal or Visa), your data will be passed on to the commissioned credit institutions or payment intermediaries in accordance with the order. Their data protection regulations apply to the processing there. Please also note that we may use service providers for the operation of our websites or for other products or services of ours.

Here it may happen that a service provider obtains knowledge of personal data. We select our service providers carefully - especially with regard to data protection and data security - and in this case take all measures required by data protection law for permissible data processing.

5. COOKIES

6. ANALYSIS TOOLS

b) Google Ads Remarketing & Conversion Tracking

For our Internet pages, we use the functions of Google Ads Remarketing, which allows us to advertise our offer in Google search results and on third-party websites. The provider is Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland, https://www.google.de/contact/impressum.html), hereinafter referred to as "Google". The function of Google Ads Remarketing serves the purpose of analyzing visitor behavior and visitor interest on our website, so that interest-based advertisements can be created on the basis of the results obtained and can be controlled in the Google display network. d) Google Tag Manager

To manage the services for usage-based advertising, we also use the Google Tag Manager. The Tag Manager tool itself is a cookie-less domain and does not collect any personal data. Rather, the tool provides for the triggering of other tags, which in turn may collect data (for this: see above). If you have made a deactivation at the domain or cookie level, this remains in place for all tracking tags implemented with Google Tag Manager.

 

e) Bing Ads

We use Bing Ads from Microsoft Corporation (Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA; hereinafter "Microsoft") on our website. When you click on an ad placed by Microsoft Bing Ads, a cookie for conversion tracking is stored on your computer. This cookie has a limited validity and is not used for personal identification. If you visit certain pages of our website and the cookie has not yet expired, Microsoft and we can recognize that you clicked on the ad and were redirected to that page. f) Facebook Website Custom Audiences ("Visitor Action Pixel").

This transmits to the server which of our Internet pages you have visited. The browser IP address of the user's terminal device used to access the page is also stored by Google. The data processing is carried out on the basis of a balance of interests, whereby our interest lies in an appealing, user-friendly design of the website. h) reCaptcha

To recognize so-called bots and to prevent misuse of our online forms, we use the tool "ReCaptcha" of the provider Google. The processing is based on a balancing of interests. i) Use of the recovery plugin from Uptain

To improve the interaction with our visitors, we use a Java-Script plugin from uptain GmbH ("uptain plugin"). j) AWIN Performance Advertising Network

We participate in the performance advertising network of AWIN AG (Eichhornstraße 3, 10785 Berlin), hereinafter "AWIN". As part of its tracking services, AWIN stores cookies for the documentation of transactions (e.g., of leads and sales) on end devices of users who visit or use websites or other online offers of its customers (e.g., by placing an order in an online store).
